Heads up….California needs money, so pay close attention to the rules of the road!

Thanks Martin,

This is a great heads up of what's going on with the money sucking politicians.
I've seen this in every aspect of the local government enforcement this year! Don't get me started!!!!

Excellent summary. Does the term, "Sheer the sheep", apply here?
Among other poor government managements, are the reasons, I'm considering moving out of this state. (although I like my friends)

Maybe Texas? It has more that 5 tracks and no state Income tax.

Here is la mesa they have run 3 fundraiser traffic stops. I have been lucky to have been going the other direction. They hit you with tickets for anything they can find. They did one in front of Costco a few days before Christmas!! Unreal. They even had guys on bikes ready to grab the people trying to get around it.

Last year I got a parking ticket in uptown, even though I had paid for the parking. It was for NOT HAVING A FRONT LICENSE PLATE ON MY PORSCHE. :banghead:

Those are the fines-but there are also court costs, etc added on. So the fine is just the bottom end of the price range...

In case you all haven't heard, as of January 1st 2010, SB 240 indefinitely extended VC 21809 that says if you pass "a stationary authorized emergency vehicle that is displaying emergency lights, a stationary tow truck that is displaying flashing amber warning lights, or a stationary marked Department of Transportation vehicle that is displaying flashing amber warning lights", you must either move at least one lane away from the vehicle or slow down.
The law was also expanded to include any Caltrans vehicles. http://www.dot.ca.gov/hq/paffairs/news/pressrel/09pr23.htm

Now think about this scenario...
You are on a freeway and see a tow truck (with flashers on) collecting a car on the side. A patrol car is parked a little way further on. If you pass the tow truck in the adjacent lane at a speed that is not "a reasonable and prudent speed that is safe for existing weather, road, and vehicular or pedestrian traffic conditions" (in the officer's judgment, of course), they can tag you for a violation of VC 21809. Ka-ching - $50. :x
At least it isn't as bad as some states, where the fine makes it worthwhile for the local gendarmerie to round up a whole bunch of folks, as in Texas. :shock:

Isn't this kind of Common Sense. I know if I see "Anyone" on the side of the Freeway, I either move a lane away or move closer to the line away from the Car/Truck/LE in the Emergency lane. Being stuck on the side of the Freeway is no joke. I hate it when drivers don't use common sense and get inches from your stranded car. That's triple for LE as Highway Patrol does this multiple times a day.

I once got stopped for making a U-turn in a tight parking lot using a handicapped spot. I did not get a ticket, but was admonished for that maneuver. I did not even realize how much that would have hurt. :banghead:

Wow, are you serious? You were just moving through it and not stopped? Sounds like an easy argument in Traffic Court as you were not Parked in any way. It then becomes a waste of your time. Usually it's the Blue Hairs that Patrol those things, was it a Sworn Officer or Volunteer?

What is interesting about this law is that it has become an instant "revenue enhancer" in some states. If you read the Snopes article, in Texas and some other states, if you don't move to another lane, you MUST reduce speed to at least 20 mph below the posted speed limit or you have a "prima facie" violation.
So - patrol 1 stops a car and parks with flashers. Everyone who now passes patrol 1 at more than 20 mph below the posted limit is now pulled over and cited by patrol 2 (and 3, 4, 5...) a little further down the freeway. Ka-ching! The first guy gets a $50 speeding ticket - the rest get $200+ "move over" violations.
Good bye, speed trap. Hello "move over" trap! :banghead:

At least in California they didn't put in the 20 mph requirement, and the fee is only $50, so the incentive to try to use this law here isn't as great as elsewhere.
